Q. WHAT IS MUSIC PUBLISHING?

Music Publishing is the business of acquiring and exploiting rights in musical compositions. It is a business based on the songs themselves as distinct from the records, films, commercials or other media in which they are used. Publishers are custodians of the song - the words and the music, and their business is to assure that they are heard and enjoyed. Copyright conveys to writers the exclusive legal right to be compensated for the use of their songs. Generally, the right to receive copyright royalties extends for the life of the writer plus between 50 and 70 years following their death, depending on jurisdiction. Income generated by the use of a song is split between the writer and publisher, with the publisher in most instances responsible for collecting income on behalf of the writer and for distributing their share.Q. WHAT'S THE DIFFERENCE BETWEEN PUBLISHING AND MASTER LICENSING?

Publishing involves the licensing of a song copyright. Licensing a master involves a particular sound recording by an artists. You normally need both licenses for a synchronization.Q. HOW CAN I FIND OUT WHO CONTROLS THE RECORDING MASTER?

Depending on the song and the nature if the request, it may take anywhere from a few days to a few weeks, or perhaps longer, to clear a song.Q. WHAT IS THE DIFFERENCE BETWEEN AN ADMINISTRATIVE AND A CO-PUBLISHING DEAL?

In an administration deal, the major publisher doesn't own any equity in the copyrights. They just collect a percentage of the money that comes in and pay the rest out to the writer and the writer's publishing company. In a co-publishing deal, the major publisher and the writer's publishing company each own 50% of the copyright.Q. HOW CAN I BECOME A SONGWRITER OR PRODUCER FOR MONSTER VISION?

There is no standard fee. Fees are based on a budget of film, music budget of film, number of licensed songs being used, popularity of song, use of song in the film (background vocal/visual vocal, visual source). Licensing must be paid for prior to the public exhibition of the film.Q. WHAT RIGHT DO I NEED TO USE A SONG IN A FILM?

Synchronization rights and master right. Synchronization rights allow you to use the words and music of the song (contact publisher) and master rights allow you to use the recording (contact owner/record label of the particular version you wish to use.) The song (words and music) can also be re-recorded for your film as long as the song has been previously recorded and released, and no substantial change in the music or lyrics is being made without permission from the publisher.YOU WILL ALSO NEED THE PERMISSION TO INCLUDE A SONG IN A FILM TO SHOW AT A FILM FESTIVAL.
